Molte costruzioni abusive rappresentano, in realtà, solo l’ampliamento di un immobile già legittimamente realizzato, perché è stato oggetto di regolare permesso di costruire, oppure perché è stata concessa una sanatoria edilizia (il cosiddetto condono edilizio).
Un garage, una stanzetta in più alla villetta, una veranda, sono tutti abusi che moltissimi proprietari di immobili commettono o hanno commesso e che rappresentano soltanto un ampliamento, ma costituiscono, se non oggetto di permesso di costruire o di permesso in sanatoria, un vero e proprio abuso edilizio per il quale il Comune, una volta venutone a conoscenza, dovrebbe emettere un’ordinanza di demolizione.
Una parte consistente degli immobili “fantasmi”, emersi con la recente operazione “case fantasma” ad opera dell’Agenzia delle Entrate, è costituita da fabbricati costruiti, ma anche solo ampliati, senza titolo edilizio e, proprio per questo motivo, mai accatastati.
Come per tutti i manufatti abusivi, è possibile – qualora l’ampliamento illegittimamente realizzato risulti conforme alla disciplina urbanistica ed edilizia vigente sia al momento in cui è stato realizzato, sia al momento della presentazione della domanda – chiedere un permesso in sanatoria ai sensi dell’art. 36 TU edilizia (DPR 380/2001).
E’, inoltre, importante evidenziare che l’art. 34 comma 2 del TU edilizio (DPR 380/2001) prevede che, quando la demolizione di un manufatto non può avvenire senza pregiudizio della parte eseguita in conformità, il Comune, invece di ordinare la demolizione, deve applicare una sanzione pecuniaria (se ad uso residenziale, pari al doppio del costo di produzione della parte dell’opera realizzata in difformità dal permesso di costruire).
Di conseguenza, quando l’esecuzione della demolizione dell’ampliamento (la veranda, la stanza in più, ma anche una nuova finestra) non può avvenire senza pregiudizio della parte eseguita in conformità, l’amministrazione deve applicare una sanzione amministrativa e non può ordinarne la demolizione.
